AndoNest is often used by families involved in custody, divorce and family-court matters. This policy explains how [ANDONEST LLC] responds to requests for user information from courts, attorneys, government agencies and law enforcement.
1. Users should get records themselves first
Every AndoNest user can export their own information, and members of a Family can generate reports of the records they are permitted to see, at any time and on any plan. In most family-law matters, the fastest and cheapest way to obtain records is for a party to export them directly from their account. We encourage attorneys and courts to ask the parties to do this before serving AndoNest.
AndoNest does not act as an expert witness, does not interpret records, and does not testify about the meaning or truth of users' content. Where required, we can provide a records custodian declaration limited to how records are stored and the integrity of the records as stored.
2. What we require
- Civil matters (including family court): a valid subpoena or court order issued by a court with jurisdiction, properly served on [ANDONEST LLC] at [REGISTERED AGENT / ADDRESS] (or by email to [email protected] where we agree to accept service that way). Out-of-state requests must be domesticated in Arizona as required by law (for example under the Uniform Interstate Depositions and Discovery Act). - Law enforcement: valid legal process appropriate to the information requested — for example a subpoena for basic subscriber information, and a search warrant for the content of communications, as required by the Stored Communications Act (18 U.S.C. § 2701 et seq.). - Emergencies: we may disclose information without legal process if we believe in good faith that an emergency involving danger of death or serious physical injury to any person, including a child, requires disclosure without delay. Requests must be submitted from an official government email with an explanation of the emergency.
Requests must identify the account (email address or account ID) and the specific information and date range sought. We may object to requests that are overbroad, unclear or unduly burdensome.
3. Notice to users
Unless prohibited by law or court order, or where notice would create a risk of harm to a child or another person, we notify affected users before disclosing their information and give them a reasonable time (generally 10 business days) to object or seek protection from a court.
4. Costs
We may charge reasonable fees for the cost of searching for, collecting and producing records in response to civil legal process, as permitted by law.
5. Preservation
We will preserve information in response to a valid preservation request for up to 90 days (renewable once) while formal legal process is obtained. Users should not rely on us to preserve information; they can export it themselves.
6. Limits
- We cannot recover information a user or Family has permanently deleted after our retention periods have passed. - We do not change, add to or remove users' records at anyone's request, and we do not resolve disputes between users about their content. - Verification codes confirm only that a report matches the records as stored in AndoNest when it was generated; they do not confirm that the content is true or complete.
